The Band Didn't Show Up: How to Recover Your Deposit and Build a Plan B in 3 Hours

The clause that is almost always missing from an agreement with musicians, the event-day clock hour by hour, how to document the breach, and what actually works to recover your deposit.

If the band does not show up, you have two separate problems and only one can be solved today: tonight's music and the money you already paid. The first is solved in about 3 hours if you act at minute 15 of the delay and not at minute 60. The second depends almost entirely on a clause that most agreements do not have: the substitution clause.

Almost everything written about music contracts is aimed at the musician who wants to get paid well. This guide is on the other side: what to demand as a client, what breaks when something fails, and how to recover what you can. It is the part nobody tells you until you need it.

The clause that is almost always missing: substitution

Most agreements made by message cover date, time, price, and deposit. Almost none cover what happens if the group cannot make it. And that is the only clause that helps you on the day you need it, because a refund fifteen days later does not save your wedding.

A substitution clause says, in simple language: "if the group cannot appear for any reason, it commits to finding a replacement of the same format and number of members at the same price, with a minimum of 24 hours' notice. If it cannot, it returns the full deposit within the following 3 days." Three lines in a WhatsApp message.

It sounds demanding and it is not: serious musicians already work this way among themselves, because the trade covers for its own. A group with a professional network finds a replacement in one afternoon. The one that refuses to write that line is usually the one with nobody to call. The complete list of what the agreement should say, point by point, is in contract and deposit when hiring musicians.

How to pay so the deposit is recoverable

The usual deposit in Mexico runs 30 to 50 percent. What decides whether that money is recoverable is not the percentage but how it was paid:

Payment methodLeaves a trailHow recoverable it is
Bank transferYes, with date, amount, and account holderHigh: there is a receipt and a real name
Deposit at the bank counterYes, with a deposit slipHigh, although it does not always identify the holder
Payment inside a platformYes, with the transaction recordedHigh: a third party holds and releases the funds
Cash with a signed receiptPartialMedium: it works, but you need to have the paper
Cash without a receiptNoLow: there is nothing to claim

Three practical rules. Transfer to an account whose holder matches the name of the person dealing with you, and if it does not match, ask why before sending. Keep the receipt and send it in the same chat where you agreed, so it sits alongside the conversation. And never pay one hundred percent in advance: the balance at the end is your only real leverage.

The 48 hours before: the window where the problem is detected

Almost all no-shows announce themselves. The sign is silence. Send a confirmation message 48 hours before with this exact content: address, arrival time, start time, number of members, and the name of the contact who will be there on the day of the event.

If they reply within a few hours confirming all five details, you are fine. If they reply with vague answers, keep pushing until you have all five. And if there is no answer after 24 hours, activate Plan B in parallel without canceling the first group: looking for an alternative does not commit you to anything and buys you the one resource that cannot be improvised, which is time. The seven classic mistakes of leaving everything until the end are in the mistakes of hiring music at the last minute.

Event day: the clock hour by hour

This is the protocol worth having written down before you need it:

  1. Agreed arrival time, plus 15 minutes. Call, do not message. An unread message is not information; an unanswered call is.
  2. Plus 30 minutes. Second call and a written message asking for confirmation that they are on their way and what time they will arrive. That message is your document: it records the time and the content.
  3. Plus 45 minutes. If there is no clear answer, activate Plan B. Do not wait for the full hour: by then you have already lost the window to find someone else.
  4. Plus 60 minutes. Final written message treating the agreement as breached and requesting the return of the deposit. No insults and no threats: just facts, times, and amount.

The detail almost nobody does and that weighs the most afterward: ask someone to record a short video of the space at the time the music was supposed to be playing. Ten seconds with the clock visible. It is the simplest proof that the service was not delivered, and it is worth more than any later argument.

The 3-hour Plan B

With 3 hours of margin there are still options, in this order of likelihood:

  • Another group of the same format in the same city. It is the first thing to look for and it works more often than it seems, especially on weekdays. Expect to pay more than the original price: whoever accepts with a few hours' notice is rearranging their night.
  • A smaller format. If there is no full mariachi, a trio or a soloist saves the key moment. Worse than a reduced format is having no music.
  • DJ or sound system with a playlist. It covers the party but not the ceremonial moment. It works as a cushion, not as a replacement for the waltz or Las Mañanitas.
  • Reorder the event. If the lost block was the 10:30 p.m. mariachi, move the dancing earlier and shift the emotional moment. A schedule can be rearranged; an hour-long gap of silence cannot be hidden.

What does not work: spending the critical hour calling fifty times the one who does not answer. Split the tasks, have someone else keep trying while you look for an alternative. And avoid closing the alternative by phone without leaving anything in writing, because in a rush you can hire as badly as you would blindly.

How to claim afterward

With the event over, the order of attempts is this. First, a direct written request with the hard facts: date, amount, proof of payment, the time they were due to arrive, and proof that they did not. Many cases are settled here, especially when the group has a public reputation to protect.

Second, the honest public review, describing facts and not adjectives. For a provider who lives on recommendations, that weighs more than any legal threat.

Third, the formal route through the consumer protection authority, which in Mexico is PROFECO. It works better when whoever charged you is an identifiable business, with a trade name and tax details, and it works worse when the deal was informal between individuals with no receipt. It is the main reason to insist on a transfer and not cash, even when the price with a transfer comes out slightly higher. The signs that point to a risky provider are gathered in how to avoid fraud when hiring musicians in Mexico.

How the risk changes when there is an intermediary

The real difference between hiring by direct message and hiring inside a platform is not the price: it is who holds the money while nobody has played yet. In a direct deal, the deposit is already in the group's account from day one. On a platform, the payment is held and released when the service is confirmed, which turns the refund into a procedure and not a negotiation.

That has a cost and it should be said clearly: on serenattia the client pays a service fee of 10 percent of the price, with a minimum of MX$200. In return, the money does not travel blind and there is a third party with the history of the conversation. The full comparison between hiring through social media, by recommendation, or through a platform is in the best ways to hire musicians in Mexico.

Frequently asked questions

Is it mandatory to return the deposit if the band does not show up?

If the service was not delivered, what applies is the refund or the agreed substitution. Whether it happens depends on you having proof of payment, a written agreement, and evidence of the time. Without those three, the claim becomes your word against theirs.

How much of a deposit should I pay as a client?

30 to 50 percent is normal in Mexico. Paying the full amount in advance removes your only leverage and gives you no benefit in return.

Does a WhatsApp agreement work as proof?

It works far better than nothing. A conversation with date, amount, address, and explicit confirmation is evidence of an agreement. That is why it is best to close everything in the chat and not by phone call.

What do I do if fewer musicians arrive than I hired?

Negotiate a proportional reduction on the spot and in writing, before they finish playing. After the event, with the balance already paid, your position is much weaker.

How long should I wait before giving up on the band?

Activate Plan B at 45 minutes of delay with no clear answer. Waiting for the full hour usually means being left without music, because by then nobody can make it in time.

Book without handing over the money blind

What reduces risk the most is simple: a verifiable profile, a written conversation, and a payment that is not released until confirmed. On serenattia you can see musician profiles with format, city, and video, keep all agreements in the chat, and confirm before the money changes hands.
